Tepper, his wife (deceased), and The Bank of Glen Burnie, recorded among the Land Records of Anne Arundel County, Maryland, in Book 4791, Page 95, and including without limitation a Modification Agreement dated March 23, 2004 and recorded among the Land Records of Anne Arundel County, Maryland in Book 14588, Page 175, which was given to secure a loan on the real property described therein, and default having occurred under the terms and conditions thereof, the undersigned Mortgage Assignees' will offer for sale at public auction AT THE FRONT DOOR OF THE COURTHOUSE FOR THE CIRCUIT COURT FOR ANNE ARUNDEL COUNTY 7 CHURCH CIRCLE ANNAPOLIS, MARYLAND 21401 TUESDAY, DECEMBER 12, 2006 AT 10:00 A.M. All that/those Lot(s) of ground situate in ANNE ARUNDEL COUNTY, Maryland, and described as follows, that is to say:
BEGINNING for the same at a stone heretofore set on the Northmost side of a 15 foot right of way at a point where the Northmost side of the said right of way is intersected by the South 09 48' East 263.80 foot line of a conveyance from Louis C. Tepper to Carl L. Tepper and Martha Tepper, dated April 9, 1943, and recorded among the Land Records of Anne Arundel County in Liber J.H.H. No. 278, folio 68; and running thence with the said last mentioned line, the reverse thereof, North 09 48' West 263.80 feet to a stone heretofore planted on the south 64 30' East 2,098 feet line of the whole tract, of which this description is a part as conveyed to Louis C. Tepper and wife by deed dated December 20, 1912, and recorded among the Land Records of Anne Arundel County in Liber G.W. No. 95, folio 239; and running thence with the said boundary, as corrected for magnetic variation, North 62 50' West, 93.92 feet to a pipe, thence running South 09 48' East 321.24 feet to a stone set on the northmost side of the aforesaid 15 foot right of way, thence running with the northmost side of the 15 foot right of way, North 79 30' East 75 feet to the place of beginning. Containing 0.504 of an acre, more or less. Being the same property described in a deed dated July 20, 1978 from Anna Naomi Tepper, now known as Naomi Chase, to Frederick A. Tepper, Jr. and Nancy L. Tepper, recorded among the Land Records of Anne Arundel County in Book 3125, page 464.
BEGINNING for the same at a concrete monument heretofore set on the northmost side of a 15 foot right of way heretofore laid out; at a point distance South 79 30' West 75 ft. from the point where the northmost side of the said right of way is intersected by the South 09 48' West, 263.80 foot line of a conveyance from Louis C. Tepper to Carl L. and Martha Tepper, his wife; by deed dated April 9th, 1943 and recorded among the Land Records of Anne Arundel County in Liber J.H.H. No. 278, folio 68, and running thence, with the westmost boundary of the lot heretofore conveyed to William P. Tepper and wife, by deed recorded among the Land Records of Anne Arundel County, North 9 48' East 321.24 feet to a stone, thence running with part of the South 64 30' East, 2098 foot line of the whole tract, of which the land herein described is a part, the reverse thereof, as corrected for magnetic variation, North 62 50' West, 91.23 feet to a stone; thence running with the eastmost boundary of the lot heretofore conveyed to Albert J. Tepper and wife, South 9 30' East, 379.91 feet to a stone heretofore set on the northmost side of the aforesaid 15 foot right of way; thence running with the northmost side of the said 15 foot right of way North 79 30' East 74.96 feet to the place of beginning. Containing 0.55 acres of land, more or less. Being the same property described in a deed dated April 26, 1961 from Frederick Tepper and Mae Tepper to Frederick A. Tepper, Jr. and Nancy L. Tepper, recorded among the Land Records of Anne Arundel County in Book 1471, page 218. From sources deemed reliable, but not guaranteed, it is believed that the properties are each improved by a dwelling. TERMS OF SALE: The property will be sold in "as is" condition, subject to any and all covenants, conditions, restrictions, easements, rights of way and limitations of record, and with no warranties. The property will be sold subject to any building or housing violations, easements, agreements, restrictions, terms, rights of way, covenants, conditions, rights of redemption, and other encumbrances, if any, affecting the subject property, whether or not of record. A deposit of Twenty Thousand Dollars ($20,000.00) will be required of the purchaser in the form of certified or cashier's check on the date of sale. The property may be subject to sale with Internal Revenue Service Right of Redemption. The Beneficiary of the Mortgage, if a bidder, shall not be required to make a deposit. Interest at the rate of eleven percent (11%) per annum shall be paid on the unpaid purchase price from the date of sale to the date of settlement if the property is purchased by someone other than the Beneficiary. The balance of the purchase price shall be paid in cash within twenty (20) days of final ratification of the sale by the Circuit Court for Anne Arundel County, time being of the essence.
If compliance with the terms of sale does not take place within twenty (20) days after final ratification, the deposit shall be forfeited and the property resold at the risk and expense of the defaulting purchaser. Taxes, water rent, and all other public charges and assessments payable on an annual or periodic basis, including sanitary and metropolitan district charges and special paving taxes, and condominium fees, if any, will be adjusted as of the date of sale and thereafter shall be paid by the purchaser.
The costs of all recordation and transfer taxes, any agricultural use or transfer tax, and any and all other costs incident to the recording of the Deed to the purchaser shall be borne by the purchaser. The Mortgage Assignees reserve the right to reject any and all bids in their sole and absolute discretion and to extend the settlement date.
Purchaser assumes the risk of loss to the property immediately after sale and shall be solely responsible for obtaining possession of the property. If for any reason the Mortgage Assignees are unable to convey title, the purchaser's sole remedy at law and equity shall be limited to the refund of the deposit to the purchaser. Upon refund of the deposit, the sale shall be null and void and have no further force of effect, and the purchaser shall have no claim against the Mortgage Assignee, Beneficiary or Auctioneers.
